SUBSCRIPTION / PURCHASE AGREEMENT FOR KOMONDOR PPC SOFTWARE SERVICE FROM PENGUIN-TEAM (PUBLIC OFFER)

Terms and Definitions:
1.1. “Contractor” – “Komondor PPC Software” (individual entrepreneur Denis Leonidovich Berezkin) website http://komondor.tools/, which provides services for automating advertising tasks.
1.2. “Subscription / Purchase” – an order to use the service. Issued for 30 days or 6 months, or 1 year.
1.3. “Subscriber” – an individual who has made a subscription/purchase in the manner prescribed by the terms of this offer.
1.4. “KOMONDOR PPC SOFTWARE” – a set of programs for a specialist in contextual advertising.
KOMONDOR PPC SOFTWARE FROM PENGUIN-TEAM Subscribers.
Subject of the Agreement:
2.1. Full and unconditional acceptance of the terms of this offer is registration on the website: http://komondor.tools/, making a payment in the amount of 100% of the prepayment of the subscription/purchase price and receiving the corresponding funds to the Contractor’s account.
2.2. This public offer is an official document and is published on the website http://komondor.tools/.
Subscription / Purchase
3.1. To subscribe/purchase, the Subscriber fills out the application posted on the website http://komondor.tools/, indicating sufficient and reliable information necessary for the execution of this Agreement, including: surname, first name; email address, telephone number for communication with the Subscriber.
3.2. The Contractor generates and sends the Subscriber a payment form.
3.3. Subscription is considered completed after checking the correctness of the data, subsequent payment by the Subscriber of the subscription cost and receipt of funds to the Contractor’s account.
Subscription terms:
4.1. The notification about the debiting of funds from the Subscriber’s card account is announced to all registered users by sending an email. The withdrawal schedule and delivery schedule are announced by sending an email.
4.2. Access to the use of KOMONDOR PPC SOFTWARE is carried out within 1 hour after debiting funds from the Subscriber’s account.
4.3. The Contractor provides access to KOMONDOR PPC SOFTWARE during the period paid by the Subscriber.
4.4. The Subscriber agrees that the Contractor uses and processes the User’s personal data in accordance with the current legislation of Ukraine / Russia / Kazakhstan.
4.5. The Subscriber agrees that after completing the registration procedure on the Site, the Contractor will send letters and messages to the Subscriber’s email address, including those of an advertising nature. At the same time, the Contractor undertakes not to transfer the email address, as well as any other information about the user to third parties.
Duties of the parties:
5.1. The Contractor undertakes to conscientiously provide access to the KOMONDOR PPC SOFTWARE service for the period specified in this Agreement in clause 4.3.
5.2. The Subscriber undertakes: in case of cancellation of the subscription to KOMONDOR PPC SOFTWARE, notify the Contractor about it before paying for the next period.
Settlement procedure:
6.1. Payment for KOMONDOR PPC SOFTWARE services is carried out in accordance with the prices approved by the Contractor and published on the Internet resource http://komondor.tools/.
6.2. The Customer pays the cost of the Subscription by debiting funds from the card account specified by him.
6.3. The Contractor has the right to unilaterally change the cost of the subscription to the KOMONDOR PPC SOFTWARE service and the conditions of this public offer without prior Agreement with the Subscriber, while ensuring the publication of the amended conditions on the Internet resource http://komondor.tools/ at least 10 days before the entry into force of the changes. In this case, the previously paid subscription price cannot be changed.
Liability of the parties, procedure for resolving disputes, special conditions:
7.1. The responsibility of the parties, not established by this offer, is determined by the current legislation of Ukraine / Russia / Kazakhstan.
7.2. The Contractor shall not be liable in the event of the improper provision of the service resulting from inaccuracy, insufficiency or untimely information and/or documents provided by the Subscriber, as well as resulting from other violations of the terms of this offer by the Subscriber.
7.3. The Contractor is not responsible for the discrepancy of the service provided to the Subscriber’s expectations and/or his subjective assessment.
7.4. The contractor is released from liability for full or partial failure to fulfill the obligations provided for in this offer, if this failure was the result of force majeure circumstances that arose after the conclusion of the contract, as a result of extraordinary events that the parties could neither foresee nor prevent by reasonable measures (force majeure ).
7.5. The Subscriber is the person indicated as the recipient on the corresponding order form on the website http://komondor.tools/
Contract time:
8.1. The Agreement comes into force from the moment specified in cl. 4.1, 4.2 of this offer, and is valid until the Parties fulfil their obligations.
Disputes between the parties:
9.1. All disputes and disagreements are resolved through negotiations between the Parties. If disputes and disagreements cannot be resolved through negotiations, they are referred to the Arbitration Court of Dnipro, Ukraine.
